% 18.04.2018 After some hearing, the counsel for the respondents fairly concedes that the application under Section 151 CPC whereby the petitioners wanted to bring on record additional material and ground of defence based on certain photographs which was declined by the impugned order dated 04.02.2016 of the Additional Rent Controller may be permitted to be taken into consideration alongside the application for leave to defend moved earlier by the petitioners which has been pending all along.
In view of the above, the impugned order is set aside. The application for placing on record additional material (photographs) and additional ground of defence taken in such context stands allowed to the effect that such grounds are permitted to be taken for consideration by the Additional Rent Controller with the other CM(M) 357/2016
grounds set out in the application for leave to defend already pending. The petition and the applications filed therewith are disposed of in these terms.
