% 26.07.2016 Response / counter affidavit has been filed by respondent no. 2. The stand of respondent no. 2/ Land and Building Department is that the entire land of the petitioner has not been acquired. The petitioner had a share in land comprising of 136 bighas and 19 biswas where as only 47 bighas and 10 biswas has been acquired; balance not having been acquired in view of the judgement passed by the Hon'ble Supreme Court in Civil Appeal No. 8289/2010 titled Delhi Administration Vs. Jai Sing Kanwar, the contention of the petitioner had been rejected. The rejection letter dated 29.09.2014 has also been filed along with the reply. Copy of the petition has been furnished to the respondent. Counsel for the petitioner states that he will take
appropriate action in accordance with law.
The second prayer which is made in the present petition which relates to the illegal allotment (qua file of the petitioner) in favour of the another person namely one Raghubir Singh son of Shri Harbans Lal is left open.
Ordered accordingly with liberty granted to the petitioner to take appropriate remedy as advised.
Petition disposed of in above terms.
