% 09.05.2018 The petitioner claims to be hawking at the Anand Vihar Bus Stand area U.P. side at Delhi and selling chola kulcha and parantha. Under the threat of removal from the site has led to the filing of the present writ petition.
Mr Mishra, learned counsel for the petitioner, submits that almost 200 vendors have been allowed to vend at an area across the road while the stand of the MCD is that the present area is a no hawking no vending area. Mr Mishra also submits that the area where the petitioner claims to be vending is comparable to the area across the road in view of the fact that there is a road, pavement, service lane, another pavement and then PWD road. Learned counsel for respondent No. 1 submits that the Anand
Vihar Bus Stand area U.P. side has been kept completely free of street vendors . A photograph of the area has been handed over in Court in support of his submission along with status report (let the status report be filed in the registry).
The learned counsel for the petitioner, at this stage, submits that he wishes to withdraw this petition as he would make a representation to the MCD and / or the TVC to seek appropriate direction to enable him to vend in the area in question. We have no hesitation in saying that as soon as the representation is made, the same shall be decided expeditiously in accordance with law.
With this direction, the writ petition and CM No. 16377/2018 are disposed of, as prayed.
