1. Mr. V.P.Singh, learned senior counsel appearing for the Petitioner on instructions states that the only relief the Petitioner is seeking at this stage is that the proceedings pending before the Sub-Divisional Magistrate (SDM) (Shahdara) pursuant to notice dated 30th July, 2016 should be disposed of in a time bound manner.
2. The Court notes that the said notice was issued to the Petitioner acknowledging receipt of his application to ascertain the ownership rights of property situated at Khasra No.58 situated at Village Zafrabad and also for demarcation of the property.
3. Admittedly, the proceedings are still pending. In the circumstances, the Court directs that the Petitioner will appear before the SDM, Shahdara on 11th February, 2019 at 3.30 p.m. in connection with the above proceedings. The SDM will endeavour to dispose of the proceedings and pass appropriate orders in accordance with law within four months thereafter.
4. The Court makes it clear that it has expressed no opinion on the merits of the claim of the Petitioner and all contentions of both sides are left open to be urged before the SDM.
5. The petition and application are disposed of in the above terms. The interim order dated 20th March 2018 is hereby vacated. S. MURALIDHAR, J.
