C.R.P. 53/2016 C.M. No.13738/2016 (stay) Submission of the petitioner is that although the order dated 17.12.2015 had granted permission to the petitioner/defendant before the Trial Court to place on record the original title deeds alone but the application which he had filed included other documents which were four relinquishment deeds dated 03.8.2012 executed by his siblings in his favour as also an Aadhaar Card and a receipt of licence fee. Submission is that these documents were necessary since the plaintiff had given his no objection to the application, the impression of the petitioner/defendant was that the application had been allowed in toto.

The order dated 17.12.2015, however, does not reflect this and rightly on the next date vide impugned order dated 28.01.2016 the Trial Judge disallowed the other documents to be taken on record. At this stage learned counsel for the petitioner seeks permission of this Court to seek a review of the order dated 17.12.2015/to file a fresh application before the Trial Court. Permission granted.
