% 14.08.2018 The present petition is pending before this Court since May, 2016. On 11th May, 2016 when the petition came up before this Court, learned proxy counsel for the petitioner sought an adjournment on the ground that the arguing counsel is seriously ill. Even on the next date i.e. 20th July, 2016 again an adjournment was sought by the learned counsel who has filed the petition on the ground that he has not recovered as yet. Despite the counsel who has filed the petition appearing on 9th September, 2016, 13th February, 2016 again adjournments were sought. On 23rd October, 2017 none appeared for the petitioner, however, in the interest of justice, this Court did not pass any adverse order and renotified the petition for the next date. On 15th February, 2018, learned proxy counsel entered appearance and again sought time on the ground that the arguing counsel is not available. CRL.L.P. 256/2016

This Court on 15th February, 2018 clearly noted that from the perusal of the order sheet it is evident that every time an adjournment is sought by the learned counsel for the petitioner. Granting last opportunity to the learned counsel for the petitioner to address arguments for issuance of notice if any, the matter was adjourned for today. Learned proxy counsel for the petitioner today again seeks an adjournment.

Petition is dismissed for non-prosecution.
