Petitioners seek quashing of FIR No.364/2008 under Section 323/341/354/34 IPC PS Kalkaji based on a settlement. Subject FIR was registered consequent to an altercation which took place with regard to parking of a car.

It is contended that parties have settled their disputes through the process of mediation at the Mediation Centre, Saket on 25.08.2017.

Respondent no. 2 is present in person in Court today, represented by her counsel and is identified by the Investigating Officer. She submits that she has settled all the disputes with the petitioners. She further submits that she does not wish to press the criminal complaints against the petitioner any further. 4.

In view of the fact that the disputes between the parties have been settled, continuation of criminal proceedings will be an exercise in futility and justice in the case demands that the dispute between the parties is put to an end and peace and harmony are restored; securing the ends of justice being the ultimate guiding factor. It would also be expedient to quash the subject FIRs and the consequent proceedings emanating there from.

In view of the above, the petition is allowed. FIR No. 364/2008 under Section 323/341/354/34 IPC PS Kalkaji, New Delhi and the consequent proceedings emanating there from are, accordingly quashed.
