% 02.05.2025 CM APPL. 26543/2025 [Modification of order dated 23.09.2024] 1.

The Petition was disposed of by a Coordinate Bench of this Court on 02.05.2024.

The present Application filed on behalf of the Respondent, although couched as a modification of the order dated 23.09.2024, seeks a release of interest of the amounts deposited in the Court. 3.

Learned Counsel for the Petitioner submits that as was directed by the order dated 23.09.2024, the interest was released in favour of the Petitioner several months ago.

Reliance is placed on the paragraph 5 of the order dated 23.09.2024 which is set out below:

"5. Accordingly, let the amount in the sum of Rs.50,000/- be released in the name of the Respondent,. The interest of the said amount shall be released in favour of the Petitioner."

Paragraph 5 of the order dated 23.09.2024 also directs that the interest will be released in favour of the Petitioner. The Order dated 23.09.2024 was passed in the presence of the Respondent. In addition to directing the release of amounts in the sum of Rs.50,000/- in favour of the Respondent, the Order directed release of accrued interest in favour of the Petitioner. 7.

The record reflects that this Court had by an order dated 02.05.2024 disposed of this matter modifying the amount awarded to the extent that in addition to the earlier award, an additional amount of Rs.50,000/- was awarded, totalling to Rs.1,00,000/- was to be paid to the Respondent/workman.

7.1 Subsequently, an Application was filed by the Respondent/workman seeking release of the amount deposited in the Court, which was allowed by this Court on 23.09.2024.

The only ground that has been taken for modification by the Respondent/Applicant is that the order dated 23.09.2024 for release of interest is "quite harsh".

In addition, the Application has been filed more than seven months after the order dated 23.09.2024 has been passed without assigning any reasons for the delay.

Accordingly, this Court finds no reason to modify the order dated 23.09.2024.

The Application is misconceived and is accordingly dismissed. 12.
