I.A.No.5640/2017 (under Order 23 Rule 3 CPC) This is an application filed by the parties jointly under Order 23 Rule 3 CPC. Learned counsel for the plaintiffs submits that in terms of the settlement arrived at between the plaintiff and defendants recorded by the Delhi High Court Mediation and Conciliation Centre on 03.02.2017 supported by an addendum dated 15.02.2017, the plaintiffs do not wish to press their suit. This settlement agreement dated 03.02.2017 as also the addendum dated 15.02.2017 are taken on

record. Parties shall be bound by the terms and conditions contained the settlement agreement dated 03.02.2017 as also the addendum dated 15.02.2017 which have duly been signed by the parties. In view of this settlement, the plaintiffs seek permission of this Court to withdraw this suit. Permission granted. Dismissed as withdrawn. I.A.No.5641/2017 (under Section 16 of the Court Fee Act) Since the matter has been settled in Delhi High Court Mediation and Conciliation Centre, court fee be returned. I.A.Nos.12356-57/2016 Since the suit has been dismissed as withdrawn, these applications have become infructuous; they are disposed of accordingly.
