% 23.01.2017 CO. APPL. 145/2017 Learned counsel appearing on behalf of the petitioner states that the underlying dispute that led to the institution of the present company petition has been amicably settled by and between the parties and the terms and conditions of the settlement are enshrined in the Compromise Deed dated 27th December 2016.
The said Compromise Deed entered into between the parties has been placed on record along with the application.
The same is lawful and is accepted.
The parties shall abide by the terms and conditions of the said Compromise Deed dated 15th December 2016, without demur. In view of the settlement arrived at between the parties as aforesaid, learned counsel appearing on behalf of the petitioner/applicant seeks leave to withdraw the present company petition.
Leave granted.
Consequently, the accompanying company petition is dismissed as withdrawn and disposed of accordingly.
Pending applications, if any, also stand disposed of.
