O R D E R

% 13.02.2017 IA No.1892/2017 (of the parties under Order XXIII Rule 3 CPC). 1.

The parties in this suit for permanent injunction restraining infringement of trademark 'VERIZON' and for ancillary relief are stated to have compromised all the disputes and differences subject matter of the suit and seek disposal of the suit in terms thereof. 2.

The counsels state that the application is signed by the authorised representative of the three plaintiffs namely Verizon Trademark Services LLC, Verizon Licensing Company and Verizon Communications India Private Limited and by the defendant no.1 Ram Krishana as proprietor of defendant no.2 Verizon Builders and Developers 3.

I have perused the contents of the application and find the agreement arrived at between the parties to be lawful.

The application is allowed and a decree is passed in favour of the three plaintiffs and against the two defendants in terms of prayer paragraph 56 (i), (ii) and (iii) of the amended plaint verified on 25th April, 2016 and in CS(COMM) No.342/2016

terms of the compromise application which shall form part of the decree sheet, leaving the parties to bear their own costs. 5.

It is however clarified that the decree of declaration of the plaintiffs' mark being a well-known trademark is on the consent of the defendants and the Court has not made any enquiry in this regard. Decree sheet be drawn up.

The date of 1st March, 2017 before the Joint Registrar stands cancelled.
