This application is taken across the Board.

This application is a joint application filed by the parties under Order 23 Rule 3 CPC. The application is signed by counsel for the parties and the parties.

The application is also supported by the affidavits of the parties.

Counsel for the defendants has handed over a cheque of Rs.50,000/- to the plaintiff in terms of the present application. 4.

The application is, therefore, allowed and the suit is disposed of by drawing up a decree as per the terms as stated in the present application.

I.A. stands disposed of.

The present suit along with I.A. No. 4561/2016 is also accordingly disposed of.

Since the suit is disposed of before recording of evidence, plaintiff will be entitled to refund of 50% of the Court fee as per Section 16-A of the Court-Fees Act, 1870 (as applicable to Delhi) and the Registry will issue necessary certificate of 50% of the Court Fees in favour of plaintiff No.1.
