Mr. Mathews, learned counsel for the petitioners, says that given the family circumstances of the petitioners they would require three months time to vacate the subject property, which is, a residential house. It is not in dispute that the subject property is a secured asset qua which the respondent bank is taking measures under the SARFAESI Act. 3.
The captioned writ petition is disposed of, as prayed, with liberty to the petitioners to move to the concerned Debt Recovery Tribunal (in short "DRT") for the said purpose. The DRT will pass orders, if moved, in accordance with law.
