O R D E R
% 18.09.2018 Learned senior counsel for the petitioner submits that petitioner was having financial dealings with the husband of complainant. Petitioner had extended a loan of ₹25 Lacs to the complainant's husband in the year 2015. Principal amount was returned.
However, disputes regarding payment of interest was lingering on. Complainant has lodged FIR against the petitioner to put pressure on him.
By placing reliance on the CCTV footage, it is contended that complainant was far ahead of petitioner, who was returning from the market after buying groceries. It is the complainant, who returned
back and started talking to petitioner. Petitioner has already participated in the investigation.
Statements of four residents of the society have been recorded out of which three witnesses namely, Shri Virender Kumar Jain, Shri Sanjay Rana and Ms.Saroj Jain have not supported the version of complainant.
Petitioner is aged about 60 years and may be granted anticipatory bail.
Learned APP submits that one witness has supported the complainant. Offence alleged is serious in nature, inasmuch as custodial interrogation of petitioner is necessary.
Keeping in mind the totality of facts and circumstances of this case, it is ordered that in case of arrest, petitioner be released on bail subject to his furnishing a personal bond in the sum of ₹20,000/-(Rupees Twenty Thousand Only) with one surety of the like amount to the satisfaction of the Investigating Officer/Arresting Officer/SHO concerned. Bail application is disposed of in the above terms. Dasti.
