O R D E R

% 24.04.2018 The petitioners have preferred the present writ petition for production of their son Mohd. Rehan before this Court. They also seek protection for the entire family of the petitioners and their three sons Mohd. Irfan, Mohd. Rizwan and Mohd. Rehan.

The background in which the present petition has been preferred is that Mohd. Rehan - the son of the petitioners, appears to have eloped with one Suman. In relation to the said incident, an FIR already stands registered at PS - Subzi Mandi on 27.03.2018, being FIR No.92/2018 under Section 365 IPC, wherein investigation is under progress. Ahmed Ansari and his two sons were picked up for interrogation by the police in the said case. Since it was claimed by one of the other sons of the petitioners viz. Mohd. Rizwan that they had not returned home, he preferred W.P. (Crl.) No. 989/2018. During pendency of that petition, the said persons returned to their residence and that petition was disposed of by this Court on 09.04.2018. Now, this petition has been preferred for production of Mohd. Rehan, who is the accused in the aforesaid case. Mr. Mehra has tendered in Court a status report, which is taken on record. From the same, it appears that proceedings under Section 82 Cr.P.C. have been initiated against Mohd. Rehan on 18.04.2018. Mr. Mehra also states that Mohd. Rizwan - the brother of the missing person, is not cooperating in the investigation and is not responding to the notice issued to him.

We are not satisfied that the present is a bona fide petition. Moreover, proceedings under Section 82 Cr.P.C. for locating Mohd. Rehan are already underway. In these circumstances, we are not inclined to entertain this petition.

Dismissed.
