O R D E R

After arguments, this appeal is disposed of with the consent order that the impugned judgment passing a decree for mesne profits at Rs.8,000/- per month is modified to mesne profits at Rs.3,500/- per month pendente lite and till vacation of the suit premises by the appellant on 31.10.2018.

It is not disputed that the charges at the admitted rate of Rs.2,700/- per month for the period from the date of filing of the suit on 1.10.2012 till 31.10.2018 have already been deposited by the appellant by means of a bank draft in the trial court. The keys of the

suit premises have also been deposited in the trial court. 3.

Trial court will now release the keys as also the bank draft deposited by the appellant in favour of the respondents forthwith. Appellant now will be liable to pay a sum of Rs.800/- per month (i.e. Rs. 3,500 - Rs. 2,700) from 1.10.2012 till 31.10.2018, and this amount be paid by the appellant to the respondents within a period of three months from today.

Counsel for the respondents will give to counsel for the appellant the details of the bank account of the respondents so that the aforesaid amount can be directly deposited by the appellant in the bank account of the respondents within a period of three months from today.

The appeal is accordingly disposed of in terms of the aforesaid consent order.
