% 01.05.2018 Crl.M.A.No.8119/2018 Allowed subject to just exceptions.

W.P.(Crl.) No.1334/2018 1.

Notice.

2.

Learned Additional Standing Counsel for the State accepts notice. 3.

By this petition, the petitioner seeks parole to find out a suitable match for his younger sister and to arrange funds for the same. Petitioner also challenges the communication dated 8th March, 2018 rejecting his application for parole on the ground as noted above. As per the nominal roll, petitioner was awarded a jail punishment on 5th January, 2018 after he was found with approximately 400 gms of tobacco packed in 24 small packets. This was the ground for rejection of the parole. Further while the W.P.(CRL) 1334/2018

application of the petitioner for seeking parole was pending before the Competent Authority, the Director General (Prisons) granted furlough to the petitioner for a period of two weeks with effect from 19th February, 2018 to 5th March, 2018 ignoring the punishment awarded on 5th January, 2018. Since after the application seeking parole was filed, the petitioner has already been released on furlough, this Court find no ground to set aside the order dated 8th March, 2018 or pass any order in favour of the petitioner granting parole.

4.

Petition is dismissed.

5.

Copy of this order be communicated to the petitioner through Superintendent, Central Jail No.14, Mandoli.
