Learned counsel for the petitioner submitted that he may be allowed to withdraw the petition with the liberty to challenge the impugned order dated 23.12.2017 by filing a revision petition before the Sessions Court and further, he may also be allowed to move an application for condonation of delay in filing the said revision petition.

Accordingly, the petition is dismissed as withdrawn with the liberty as prayed for. Pending application is also dismissed as withdrawn.

The petitioner may move the application for condonation of delay in filing the revision petition before the Sessions Court and the Sessions Court is directed to decide and dispose of the said

application in accordance with law.

It is clarified that this Court has not expressed any opinion on the merits of the petition.
