% 20.02.2019 Looking into the facts of the case, which involves the accidental death of a person who was working for the petitioner, no case is made out for quashing of FIR No. 0018/2018 registered under sections 288/336 IPC at Police Station, Mianwali Nagar, Outer District, Delhi, on the basis of a settlement. The amounts paid by the petitioners to the LR's of the deceased, shall be deemed to be without prejudice to the rights of the parties to claim compensation in terms of the Employees' Compensation Act, 1923 and other statutory protections. An amount of Rs. 5 lacs paid by the petitioners and deposited in terms of the order dated 11.10.2018 shall be appropriated by respondent no. 2 in terms of the said order. In view of the above, the petition is liable to be dismissed. At this stage, the learned counsel for the petitioners seeks to withdraw the petition. The petition is dismissed as withdrawn.
