% 29.04.2016 Ms.Nandita Abrol, learned counsel appears for the respondents, states that she has no objection if a sole arbitrator is appointed to adjudicate the dispute between the parties. She also states that the petition under Section 9 of the Arbitration and Conciliation Act being OMP(I)(COMM) 118/2016 can also be disposed of with liberty to the petitioners to move an appropriate application before the sole arbitrator.
Mr.Deepak Thakur, learned counsel is agreeable to this submission of the learned counsel for the respondents. Noting the stand of the learned counsel for the parties, I appoint
Justice Anil Kumar, a retired Judge of this Court as a sole Arbitrator to adjudicate the claims and counter claims of the parties under the aegis of Delhi International Arbitration Centre. The fee of the learned Arbitrator shall be regulated by the rules of the Centre. The petitioners would be at liberty to file an application under Section 17 of the Arbitration and Conciliation Act, seeking interim order. The petitions are disposed of.
Copy of this order be sent to the co-ordinator of the Delhi International Arbitration Centre (DAC).
