CONT.CAS(C) 294/2018 1.

The present petition has been filed alleging non-compliance of order dated March 08, 2018. The operative part of the order reads as under:- "In view of the said statement, the petition is disposed of with a direction that the representative of the petitioner and the respondent No.2 shall hold a meeting at the site within one week from today when the petitioner shall identify the place; pursuant thereto, the respondent no.2 shall notify the petitioner, the cost involved for shifting of the pole. Once the cost is

deposited and NOC (if any) is provided to the Respondent no.2, further action shall be taken and completed by the respondent no.2 within two months thereafter."

It is the submission of the learned counsel for the petitioner, in terms of the said order the respondent was to inform the petitioner the cost involved in shifting the pole, which has not been done. 3.

Mr. Srivastava, even though disputes the said submission, has handed over a copy of the demand note dated April 23, 2018 whereby the respondent has called upon the petitioner to deposit an amount of `98,985/-. 4.

Learned counsel for the petitioner states, the petitioner shall deposit the amount to enable the respondent take further action in terms of the order dated March 08, 2018.

Noting the said submission, the contempt petition is closed. It is made clear that the further action shall be strictly taken by the respondent in terms of order dated March 08, 2018.
