% 09.05.2018 After some hearing, counsel for the petitioner submits that the petitioner would file an appeal before the Commissioner (Appeals). She, however, states that the respondent-authority has collected and have documents/papers, which are in favour of the petitioner, but have not been referred to the order-in-original. It will be open to the petitioner to file the said documents/papers before the Commissioner (Appeals) and in case papers/documents are not available, the Commissioner (Appeals) would be requested to summon the said file and examine the documents/papers. We further observe that in case the appeal is preferred by the petitioner within fifteen days, the same would not be dismissed on ground of limitation.

Counsel for the petitioner states that there is urgency in the matter because imported consignments have been detained/seized. This request may be made to the Appellate Authority. We clarify that we have not made any comments on merits.

The writ petition is disposed of in the aforesaid terms, without any order as to costs.
