% 25.04.2018 It is submitted that respondent no.2 was tenant of petitioner no.2; whereas petitioner no.1 is uncle of petitioner no.2. A quarrel took place between them on some trivial issue which led to registration of FIR No. 57/2018 under Sections 380/448/34 IPC at police station Dabri, on the complaint of respondent no.2. It is further submitted that with the intervention of their common friends and other family members, petitioners and respondent nos.2 have settled their disputes amiably vide Memorandum of Settlement dated 23rd April, 2018, therefore, FIR may be quashed. Respondent no. 2 is present in Court along with his counsel and has been identified by SI Devesh of police station Dabri. He submits that he has
settled the matter with the petitioners of his own free will and without any undue force, pressure or coercion, therefore, he has no objection in case FIR is quashed. He also admits having received entire settled amount of `3.5 lacs from the petitioners.
Keeping in mind the settlement arrived at between the petitioners and respondent no.2 voluntarily, in the interest of justice, aforesaid FIR, which is at the investigation stage, is quashed.
Petition is disposed of in the above terms. Miscellaneous application is disposed of as infructuous.
