By filing the present bail application, the petitioner is seeking regular bail in case FIR No.152/2009 under Section 3 of MOCA Act, PS Kalkaji, Delhi.

Proxy counsel for the petitioner is present and submits that main counsel is not available today.

On behalf of State, it has been informed that the petitioner is not in judicial custody. Learned APP for the State has submitted that vide order dated 08.03.2016 the petitioner was granted interim bail for a period of twenty days. However, the petitioner failed to surrender after availing interim bail vide order dated 08.03.2016 passed by learned Trial Court. The bail application has been dismissed on 4th April, 2016 by the learned ASJ. 4.
Proxy counsel for the petitioner has been repeatedly questioned as to BAIL APPLN. 769/2016
whether the petitioner is in custody or on bail but he stated that he being the proxy counsel, is not aware about the same.

In the given circumstances, since the petitioner is seeking regular bail in case FIR No.152/2009 under Section 3 of MOCA Act, PS Kalkaji, Delhi and it has been informed by learned APP for the State that the petitioner has failed to surrender despite dismissal of his application by the learned ASJ, the instant bail application is hereby dismissed.
