O R D E R

% 25.04.2016 Having heard counsel for the petitioner, we are not inclined to interfere with the impugned order dated 21st January, 2016 dismissing the contempt application for lucid and valid reasons given therein. It is noticeable that the petitioner's contractual appointment was not terminated and he was allowed to continue during the tenure of the entire contractual term upto 31st August, 2014.

One of the contentions raised before us is that the petitioner in fact had worked upto 1st January, 2015. Payment of salary was not a subject matter of any interim order passed by the tribunal. If the petitioner has any

grievance in this regard, it will be open to the petitioner to take steps in accordance with law in the proceedings which are pending before the tribunal.

However, we are inclined to waive the cost of Rs.25,000/- imposed on the petitioner while dismissing the contempt application vide order dated 21st January, 2016. We have also heard counsel for the respondent on the said aspect. To waive the cost, we would only observe that it does appear that the petitioner had proceeded bonafidely. The writ petition is accordingly disposed of. SANJIV KHANNA, J.
