% 23.10.2018 After some hearing, the learned counsel for the petitioner submitted that he may be permitted to withdraw the present petition, his only apprehension being that certain observations adverse to his interest as recorded by the court of the Magistrate and the revisional court in the impugned orders may be treated as conclusive. The apprehensions are misplaced as observations made at the interim stage of release of case property on superdari can never be treated as final, binding or conclusive. With this clarification, as requested by the counsel for the petitioner, the petition is dismissed as withdrawn. All contentions of both sides are kept open.
