CORAM:

HON'BLE MR. JUSTICE A.K. PATHAK

O R D E R

% 12.07.2018 Crl. M.A. no.8273/2018 (exemption) Allowed, subject to all just exceptions. Application is disposed of. CRL.M.C. 2326/2018 Notice. Learned APP accepts notice.

Respondent no.2 Mr.Dharampal is present in Court along with his counsel and has been identified by SI Naveen Kumar of PS Subzi Mandi. Respondent no.2 accepts notice and submits that he has settled the matter with the petitioner of his own free will and without any undue force, pressure or coercion before the trial Court in CR No.25/2018 titled as

Taranjit Singh Chadha vs. State and Ors. inasmuch as settled amount of Rs.3,50,000/- stands paid.

Respondent no.2 submits that he has received the settled amount and has no objection in case FIR No. 5/2007 under Sections 464/465/409/420/468/471 IPC registered at police station Subzi Mandi and consequent proceedings are quashed against petitioner. Keeping in mind the settlement arrived at between petitioner and respondent no.2 voluntarily, in my view, no fruitful purpose would be served in keeping the criminal proceedings pending. Accordingly, in the interest of justice, aforesaid FIR and the consequent proceedings emanating therefrom are quashed.

Petition is disposed of in the above terms.

Dasti.
