Mr. Rajender Arya, the learned counsel for the petitioner states that the vacant physical possession of the shop in question has been handed over to the petitioner by the respondent on 31.01.2019. 2.

The respondent Mohd. Mehboob Ilahi had died on 02.03.2017 and had given the undertaking to handover the possession of the shop in question and to make the payment of use and occupation charges. The possession of the shop in question has already been handed over to the petitioner by his legal heirs.

In the circumstances, since the respondent, who had given the undertaking to make the payment of use and occupation charges, had died, nothing survives in the petition.

The petition along with application being CM No.51635/2018 is dismissed.
