O R D E R

% 10.05.2018 It is submitted that petitioners and respondent no.2 have settled their disputes amicably, therefore, FIR No.

583/2017 under Sections 448/453/380/34 IPC registered at police station Ambedkar Nagar may be quashed. Respondent no.2 (complainant) is present in Court along with his counsel and has been identified by SI Vishal Tiwari of police station Ambedkar Nagar.

He submits that he has settled the matter with the petitioners of his own free will and without any undue force, pressure or coercion vide Settlement Deed-cum-Memorandum of Understanding dated 5th April, 2018.

He further submits that entire settled amount has been

received by him from the petitioners, inasmuch as, petitioners have handed over key of the subject property to him today in Court. He has no objection in case the FIR is quashed.

Keeping in mind the settlement arrived at between the petitioners and respondent no.2 voluntarily, in my view, no fruitful purpose would be served in keeping the criminal proceedings pending. Accordingly, in the interest of justice, aforesaid FIR and the consequent proceedings emanating therefrom are quashed.

Petition is disposed of in the above terms.
