O R D E R

% 23.02.2017 IA No.2434/2017 (of the Defendant no.1 under Order XII Rule 6 CPC) 1.

Counsel for all the three plaintiffs viz. Smt. Veena @ Simran, Baby Barbie and Master Chanakya states that the plaintiffs, in terms of settlement arrived at on 31st August, 2016 before the Principal Judge, North-West, Family Court, Rohini withdraw the suit with liberty to file again if the defendant no.1 does not pay the sum of Rs.14,000/- per month as maintenance. It is further stated by the counsel for the plaintiffs that out of the amount of Rs.4,58,241/- mentioned in the order dated 31st August, 2016 supra, the balance amount due of Rs.3,97,143/- is being received today by demand draft No.019069 dated 8th December, 2016 drawn of Axis Bank, Chittaranjan Park, New Delhi in the name of the plaintiff no.1 Smt. Veena @ Simran and with receipt thereof the entire amount of Rs.4,58,241/- stands paid.

The counsel for all the defendants states that the plaintiff no.2 Baby Barbie has attained majority and plaintiff no.3 Master Chanakya will attain majority in July, 2017.

The counsel for the plaintiffs states that the plaintiff no.1 Smt. Veena @ Simran as well as the plaintiff no.2 Baby Barbie are present in the Court and he will today hand over to the Court Master his vakalatnama from plaintiff no.2 Baby Barbie and his statement aforesaid is on behalf of plaintiff no.2 Baby Barbie also. He further states that the said withdrawal is in the interest of plaintiff no.3 Master Chanakya and he has satisfied himself in this regard.

The counsel for the plaintiffs to sign this order today itself in token of his confirmation of the same.

The suit is dismissed as withdrawn with liberty aforesaid and leaving the parties to bear their own costs.
