Let this application (I.A. No.3051/2016) be listed in the supplementary list as per the request made on behalf of the counsel for the parties on account of urgency because matter is being compromised and pay orders have to be handed over to some of the parties to the suit. 2.
This is an application under Order 23 Rule 3 of Code of Civil Procedure, 1908 (CPC) which is signed by the plaintiff as also the defendant nos.2 to 5.
Defendant no.1 has already expired.
As per the settlement, defendant nos.2 and 3 will become absolute owners of the suit property CS(OS) No.1618/2010
no.B-98, Defence Colony, New Delhi on the defendant nos.2 and 3 paying a sum of Rs.60 lacs in favour of the defendant no.4/mother as per the agreement between the parties to the present application. 3.
Pay orders totalling to a sum of Rs.60 lacs after deducting TDS have been paid over to the counsel for the plaintiff and who will hand over the pay orders to the defendant no.4/mother.

Accordingly, suit is disposed of as settled in terms as recorded in the present application. Parties are left to bear their own costs. Parties will abide by the terms of the settlement and terms of which settlement will form part of the decree and the decree will be drawn up in terms of the settlement.
