W.P.(C) 3709/2016 & CM No.15811/2016 The petitioner has impugned order dated 13.02.2014 passed by learned Presiding Officer, Labour Court, Karkardooma Courts, Delhi in Misc. Appl. No.3/12 in ID No.172/11 titled as 'Shri Abhinandan Singh vs. M/s. Ajay Plastic' whereby the application for setting aside order dated 30.11.2012 filed by the petitioner was dismissed. Learned counsel for the petitioner submits that the petitioner has earlier filed writ petition bearing W.P.(C) No.10243/2015 and the same was dismissed as withdrawn with liberty to file a fresh petition with better particulars.

A perusal of file reveals that para 5 of the petition mentions that

the petitioner has not filed any other proceedings. After some arguments, Mr.Krishna Dev Pandey, learned counsel for the petitioner seeks permission to withdraw the present petition and application with liberty to file a fresh petition after disclosing the complete facts.

As prayed, the petition as well as application are dismissed as withdrawn.
