O R D E R

1. This is a petition under Section 11 of the Arbitration and Conciliation Act, 1996 ('Act') filed by the Petitioner against the Respondents seeking the appointment of an Arbitrator to adjudicate the disputes between the parties.

2. The mediation report indicates that the matter was fixed for mediation on 12th July 2016, 29th July 2016 and 22nd August 2016 and that despite notices none appeared before the learned Mediator.

3. The averment in the petition that there is an arbitration clause in the Agreement entered into between the parties remains uncontroverted.

4. The Court accordingly, appoints Mr. Ruchir Bhatia Advocate, (Mobile No. 9810371417) as sole Arbitrator to adjudicate the disputes between the parties including their claims and counter-claims. All contentions of the parties in law and on facts are left open to be urged before the learned

Arbitrator in accordance with law. The arbitration shall take place under the aegis of the Delhi International Arbitration Centre (DAC). The fees of the learned Arbitrator will be in terms of the Delhi High Court Arbitration Centre (Arbitrators' Fees) Rules.

5. The petition is disposed of. A copy of this order be communicated to Mr. Ruchir Bhatia, the learned Arbitrator as well as Additional Coordinator, DAC forthwith.
