% 11.05.2016 Present writ petition has been filed seeking a direction to respondent No.2-Regional Passport Officer to make correction in petitioner's passport in respect of his date of birth. It has been averred in the petition that petitioner's date of birth was inadvertently recorded as 07.07.1998 instead of 07.07.1999 in his passport as the same was issued on the basis of Birth certificate which also mentions the incorrect date of birth.

Learned counsel for petitioner states that the fresh birth certificate with the correct date of birth i.e. 07.07.1999 has been issued to the petitioner and after obtaining the same, petitioner approached the respondent No.2 vide application dated 1st February, 2016 for making correction in his passport, however, respondent No.2 orally asked the petitioner to bring a declaratory order from a Court. A perusal of the paper book reveals that the petitioner's application dated 1st February, 2016 has not been rejected till date by

way of a written order.

Consequently, the present writ petition is disposed of with a direction to the respondent no.2 to decide the petitioner's application dated 1st February, 2016 by way of a reasoned order within a period of two weeks.

This Court however clarifies that it has not expressed any opinion on the merits of the controversy. The rights and contentions of all the parties are left open.
