Learned counsel for the petitioner states that he has instructions not to press the petition because the petitioner will in fact re-commence the enquiry proceedings against the respondent no.1, inasmuch as, the enquiry proceedings are set aside on a technical ground only. It is also submitted before this Court that petitioner has various other rights during continuation of the fresh enquiry proceedings as against the respondent no.1, and which rights the petitioner proposes to exercise.
