Lest the petition suffers a dismissal on a technical account, which we unfortunately find is the second failed attempt by learned counsel for the petitioner, we permit the petition to be withdrawn for the reason notice has not been issued therein. Liberty granted to the petitioner to file a fresh petition on the same cause.
