% 20.03.2017 The petitioner has filed the present petition under Article 226 of the Constitution of India for issuance of a writ of habeas corpus whereby a direction is sought for production of Smt.Santosh, who is stated to be the wife of the petitioner.
The prime purpose of this petition apparently seems to be that after parties entered into an amicable settlement for dissolution of the marriage by way of mutual consent, the petitioner claims that his wife was not cooperating.
On an advance, copy having been served, the respondent No.3, father
of Smt.Santosh, and Smt.Santosh are present in Court. They submit that after the settlement, the petitioner has not approached them and they are principally not averse to a settlement.
Mr.Mehra, learned Standing counsel for the State, submits that the petition is a gross abuse to the process of law and in fact it should be dismissed with heavy cost. At this stage learned counsel for the petitioner wishes to withdraw this petition.
Parties request that the matter may be sent to Delhi High Court Mediation Centre today itself since the respondent No.3 has come from Himachal Pradesh. Parties agree to co-operate with the mediator. List the matter before the Mediation Centre today itself. The writ petition is dismissed as not pressed. Dasti. -c.
