% 18.04.2016 Writ petition has already been allowed vide order dated 7th April, 2015 whereby impugned order dated 9th October, 2014 has been set aside and matter has been remanded back to the Recommendation Committee. It was further directed that petitioner shall furnish relevant documents with the Recommendation Committee within four weeks and petitioner's application shall be heard and decided by the Recommendation Committee within a period of four weeks thereafter.
Recommendation Committee was directed to afford opportunity of hearing to the petitioner before deciding the matter. While allowing the writ petition certain guidelines were suggested by the Court regarding the manner in which applications for allotment of alternative plots were to be scrutinised and decided.
Counsel for the respondent no. 1 brought to the notice of the Court that there was a policy of a Government with respect to the allotment of alternative
plots.
Respondent no.1 was directed to place the policy on record. It was further directed that in case policy was not comprehensive enough Chief Secretary, Govt. of NCT of Delhi shall consider the suggestions of the Court, as stipulated in the order, to take a comprehensive view.
On 28th April, 2015, certain suggestions were put forth by the counsel for the petitioner for expeditious disposal of the applications for allotment of alternative plots. Counsel for the respondent no.1 produced Scheme for allotment of alternative plots and the various orders passed from time to time as well as the Standard Operative Procedure. Thereafter, matter was renotified for 15th May, 2015 wherein all the suggestions were considered.
statement was made by the learned counsel for the respondent/Land & Building Department that all the pending applications had been scrutinised and the status of the Scheme has also uploaded on the website. It was further informed that letters were also issued.
Accordingly, respondent/Land & Building Department was directed to file an affidavit thereby giving complete details and particulars within four weeks. Affidavit has not been filed. Let the affidavit, in terms of the order dated 15th May, 2015, be positively filed within four weeks. No further orders are required to be passed in the matter. A.K. PATHAK, J.
