% 10.05.2018 Mr. R.K. Saini, Advocate informs the Court that he has been instructed not to appear in the matter last night. We have asked Mr. Anil Kumar Chandel, Advocate, who is now seeking permission to put his appearance in the matter, as to whether he has taken 'No Objection Certificate' (NOC) from Mr. R.K. Saini, who was earlier appearing in the matter. The answer is in the negative. We find it rather unfortunate that even prior to the NOC being obtained, the counsel has decided to appear in the matter.

Mr. Anil Kumar Chandel, counsel appearing for the petitioner, on instructions from the petitioner, wishes to withdraw this petition in view of the fact that the Bank has rejected the proposal of the petitioner and the fact that Receiver has taken possession of the tenanted property. Counsel further submits that respondent no.1/Bank has disobeyed the order passed by this Court on 02.05.2018 and for which, he would seek appropriate remedy. The writ petition is dismissed as withdrawn in above terms. In case, any petition is filed, the same would be considered in accordance with law.
