Considering that a petition under Section 11 of the Act has been filed by the Petitioner before the Bombay High Court and considering that no interim order has been passed in this petition till date, it is directed that it will be open to the Petitioner to seek appropriate interim orders in the arbitral proceedings in accordance with law as and when an Arbitrator is appointed. It is made clear that this Court has not decided the objection raised by the Respondent to the maintainability of this petition in this Court.

2. The petition is disposed of in the above terms. The application is also disposed of.
