O R D E R

% 18.07.2018 Learned counsel for the petitioner submits that no PCR call was made by the complainant immediately after the alleged robbery. FIR was registered after five hours.

Petitioner and complainant are living in the adjoining area. Petitioner was apprehended after six days. Petitioner is in custody for about seven months. Petitioner has no previous criminal record. Petitioner may be admitted to bail.

Learned APP submits that complainant had apprehended co-accused Sajan (juvenile). Petitioner had succeeded in escaping. Complainant found the petitioner roaming near the police post in the slum area, opposite DDA

flats, where complainant was staying.

Complainant apprehended the petitioner and brought him to the police station. Thereafter, petitioner was arrested. Mobile phone was recovered from the petitioner. Learned counsel for the petitioner submits that mobile phone has been planted as it is quite unnatural that petitioner would have kept the mobile phone for six days with him.

Keeping in mind the totality of the facts and circumstances of this case, petitioner is admitted to bail, subject to his furnishing a personal bond in the sum of `20,000/- (Rupees Twenty Thousand Only) with one surety in the like amount to the satisfaction of the trial court.
