CM(M) 486/2018 & CM Nos. 16876-77/2018 After some hearing, the counsel for the petitioner submits that he may be allowed to withdraw the present petition and the applications filed therewith and instead be given liberty to approach the first appellate court by review application within a week to point out the factual errors in the report of the Nazir.
The petition and the applications filed therewith are dismissed as withdrawn with liberty as prayed for granted. CM(M) 486/2018
The counsel for the respondent who has appeared on advance copy undertakes that the eviction order shall not be executed for a week which is the time allowed for filing review and further that in the event of review petition being filed within the said period, the eviction order will not be executed till decision is taken on such review application.
