% 29.09.2016 W.P.(C) 4566/2014 and CM No. 9088/2014 There are two petitioners before this Court. Prayers in the writ petition have been perused. They are bordered on the premise that the petitioners may not be disturbed/ interfered with in their squatting activities. Petitioner no. 1 is stated to be squatting at corner of Delhi Public Library, near G-402, Sarojini Nagar, New Delhi and petitioner no.2 is stated to be squatting near CGHS Dispensary, near shop no. G-149, Sarojini Nagar, New Delhi. Counsel for the petitioners additionally submits that after the promulgation of the Street Vendors (Protection of Livelihood and Regulation of Street Vending) Act, 2014 she has adequate protection under Section 3(3) of the said Act.

She has relied upon the judgment of Division Bench passed in LPA No. 136/2016 titled Bhola Ram Patel Vs. NDMC & Anr as also the subsequent judgment delivered by the Division Bench dealing with the clarification of judgment of Bhola Ram in LPA No. 353/2016 (CM APPL. 30483/2016) titled Vishnu Sharma & Ors. Vs. NDMC and in LPA No. 256/2016 (CM APPL. No. 30487/2016) titled Ranjeet & Ors. Vs. NDMC which was delivered on 27.09.2016. Additional submission being that this judgement has protected her. Per contra, counsel for the respondent submits that since the TVC of the NDMC has since been constituted, grievances if any, of the petitioners be addressed before the TVC.

Petitioners are accordingly given liberty to approach the TVC. The orders passed in the judgements (supra) will also be abided with by the respondent.
