% 21.04.2016 Present writ petition has been filed challenging the order dated 10th April, 2016 whereby the respondent No.1-AICTE has withdrawn its approval given to the petitioner after finding various deficiencies. The petitioner was further directed to transfer all the existing students to a nearby AICTE approved institution.

Learned counsel for petitioner states that petitioner has filed an appeal with Standing Appeal Committee against the impugned order dated 10th April, 2016 under Chapter IV Rule 1.2 of the Approval Process Handbook of AICTE for 2016-17.

In the writ petition, it has been averred that no actual date of hearing has been fixed and it is unlikely that the appeal would be heard before the cut-off date i.e. 30th April, 2016.

Learned counsel for AICTE states that the petitioners' appeal has been listed for hearing on 22nd April, 2016. He further states that till the petitioners' appeal is disposed of, the impugned order shall not be given effect to.

This Court is of the view that the statement made by learned counsel for AICTE is reasonable and fair. Therefore, the same is accepted by this Court and the respondent-AICTE is held bound by the same.

Consequently, the present writ petition and the applications are disposed of with a direction to the Standing Appeal Committee to dispose of the petitioners' appeal as expeditiously as possible, preferably on or before 28th April, 2016.
