% 21.09.2017 On the oral prayer made by the learned counsel for petitioners, Shri Rajesh Kumar S/o Shri Ram Sharan is impleaded as respondent no. 3. Amended memo of parties be filed during the course of the day. It is submitted that petitioners and respondent no. 3 have settled the matter with respondent no. 2 before the Mediation Centre, Tis Hazari Courts, Delhi on 18th February, 2015; FIR No.140/2012 under Sections 324/34 IPC registered at police station Punjabi Bagh on the complaint of respondent no. 2, may be quashed. Respondent no. 2 is present in Court and has been identified
by SI Nitin, P.S. Punjabi Bagh. Respondent no. 2 admits having settled the matter with the petitioners and respondent no. 3 before the Mediation Centre. He has also identified his signatures on the mediation report at point "X". He says that he has already received the entire settled amount of `18,000/-. Respondent no. 2 further says that he has settled the matter with the petitioners and respondent no. 3 of his own free will and without any undue force, pressure or coercion. Respondent no. 2 submits that he is not willing to pursue the FIR any further and the same may be quashed.
Keeping in view the settlement arrived at between the petitioners and respondent nos. 2 and 3 voluntarily, in the interest of justice, FIR No.140/2012 under Sections 324/34 IPC registered at police station Punjabi Bagh and the consequent proceedings emanating therefrom are quashed. Petition is disposed of in the above terms. Miscellaneous application is disposed of as infructuous. Dasti.
