% 29.04.2016 Crl.M.A. 6949/2016 (Exemption) Application is allowed subject to just exceptions. Crl.M.C. 1630/2016 The present petition has been filed under Article 227 of the Constitution of India read with Section 482 Cr.P.C. for setting aside the order dated 15.01.2016 passed by the Court below. It has been argued by the counsel for the petitioner that a complaint was filed by the complainant/petitioner with the allegations under Section 8 & 9 of the Prevention of Corruption Act and sanction under Section 19 of the Prevention of Corruption Act is required only against the public servants who acted in the said capacity.
The present petition is disposed of with the observations that the petitioner may move the application before the Trial Court with this aspect and the learned Trial Judge shall decide the application after hearing the petitioner.
