It is informed that the wife of the petitioner has already undergone surgery.

Learned Additional Public Prosecutor for the State submits that as per the medical opinion received, immediate surgery of spinal cord is not advisable immediately after a cardiac surgery, which the father of the petitioner has undergone.

Learned counsel for the petitioner seeks leave to withdraw the petition with liberty to apply afresh as and when spinal surgery of the petitioner's father would be scheduled.

In view of the above, learned counsel for the petitioner submits that the petitioner shall surrender before the Jail Superintendent today itself, i.e. on 28th May, 2018.

In view of the above, the Petition is dismissed as withdrawn. 6.
