O R D E R

Petitioners seek quashing of FIR No.525/2014 under Sections 392/411/34 IPC registered at PS Subzi Mandi based on the settlement. 2.

Allegations against the petitioners are that the petitioners had caught hold of the complainant and snatched his mobile, watch and some money.

It is stated that the parties have settled their dispute vide Compromise Deed dated 06.02.2018. As per the settlement, the petitioners have agreed to pay a sum of Rs.60,000/- to the complainant/respondent No.2. A sum of Rs.60,000/- has been paid to the complainant/respondent No.2 by the petitioners, in cash, today before the Court.

Complainant/Respondent No.2 is present today in the Court and CRL.M.C. 2207/2018

has been identified by the Investigating Officer. He submits that he has settled the dispute with the petitioners and is agreeable to the settlement and does not wish to press the criminal charges against the petitioners any further.

In view of the fact that the disputes between the petitioners and the respondent No.2 has been settled, continuation of criminal proceedings will be an exercise in futility and justice in the case demands that the dispute between the parties is put to an end and peace is restored; securing the ends of justice being the ultimate guiding factor. It would be expedient to quash the subject FIR and the consequent proceedings emanating there from.

In view of the above, the petition is allowed. Accordingly, FIR No.525/2014, under Sections 392/411/34 IPC registered at PS Subzi Mandi and the consequent proceedings there from are quashed, subject to the petitioners depositing consolidated costs of Rs. 10,000/, to be paid to the Delhi High Court Advocates Welfare Trust within four weeks. The receipt of deposit of the costs imposed by this Order be furnished to the concerned Investigating Officer within a period of five weeks from today.
