% 29.08.2018 Respondent No.2 is unserved as no such person was found residing. A Status Report has been handed over, which is taken on record. As per the Status Report, since the victim was a minor though she married the petitioner and was on family way when she was recovered, charge-sheet for offences punishable under Section 363/366/376 IPC and Section 6 of the Protection of Children from Sexual Offences Act has been filed and charges for the aforesaid Sections have been framed against the petitioner vide order dated 21st August, 2018.
Faced with this situation, learned counsel for the petitioner seeks leave to withdraw this petition with liberty to take the pleas raised therein W.P.(CRL) 1299/2018
during the course of trial or any other legal remedy as available in law. Leave and liberty granted.
Petition and both the applications are dismissed as with withdrawn. MUKTA GUPTA, J.
