% 11.07.2016 The petitioner seeks parole for a period of three months so as to be able to engage a counsel for filing a Special Leave Petition before the Supreme Court as well as to arrange for funds for the said purpose and to reestablish his social ties in the society. The petitioner stands convicted under Section 20 NDPS Act and has been sentenced to undergo rigorous imprisonment for a period of 10 years with fine of Rs.One Lakh and in case of default of fine, to undergo simple imprisonment for one year. The nominal roll dated 04.04.2016 discloses that the petitioner has undergone incarceration for 4 years 8 months and 3 days as on that date. Thus, even as on date the petitioner has undergone less than 5 years of

incarceration. The petitioner has not disclosed any local address. The learned APP submits that the petitioner has no local address. In case he absconds it would be very difficult to trace the petitioner. It is further submitted that the Special Leave Petition could also be filed through the jail.

Considering the aforesaid circumstances, I am not inclined to release the petitioner on parole at this stage since the petitioner can avail his rights by filing Special Leave Petition through jail as well. Dismissed.
